PLEASE READ THESE TERMS OF SERVICE (“TERMS”) CAREFULLY BEFORE USING THE PLATFORM. THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND PICK IT TICKET.
By accessing or using the Pick It Ticket platform, including all associated services, websites, and mobile applications (“Platform”), you affirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other applicable legal agreements and disclosures. If you do not agree to these Terms, you are not authorized to access or use the Platform.
For purposes of these Terms:
“Company,” “we,” “us,” or “our” refers to Pick It Ticket.
“User,” “you,” or “your” refers to any individual who registers for or uses the Platform.
“Wager” refers to any real-money or simulated bet placed through the Platform.
“Content” refers to all text, images, logos, audio, video, data, software, and other materials provided or generated by the Platform or its users.
To use the Platform, you must:
Be at least 21 years old, or the minimum legal gambling age in your jurisdiction;
Be a resident of, and physically located in, a jurisdiction where online sports wagering is legal and Pick It Ticket is authorized to operate;
Register using your real name, accurate contact information, and valid identification;
Not be a person barred from using the Platform under any applicable law or regulation.
We reserve the right to request documentation to verify your identity and eligibility at any time. Access may be restricted or denied based on jurisdictional requirements.
You agree to provide truthful, accurate, and complete registration data and to maintain the accuracy of such information throughout your use of the Platform.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use or security breach.
We reserve the right, in our sole discretion, to suspend or terminate your account for any reason, including but not limited to: violation of these Terms, fraudulent activity, regulatory noncompliance, or harm to the integrity of the Platform.
All wagers must comply with applicable laws, our house rules, and integrity standards. We prohibit insider betting, collusion, and any form of manipulation or unfair advantage.
We reserve the right to accept or reject any wager, or a portion thereof, at our sole discretion. Wagers are not valid until confirmed by our servers.
All winnings are subject to validation. We may withhold payouts for verification purposes or if we suspect irregular activity.
We may impose wagering limits (maximum/minimum bets), daily transaction limits, deposit/withdrawal thresholds, and other restrictions as necessary for legal compliance or risk mitigation.
All financial transactions are processed via third-party providers subject to their own terms and security standards. By using our Platform, you agree to their terms of service as well.
We monitor all transactions for signs of money laundering, chargeback fraud, and other financial crimes. We reserve the right to freeze or close accounts suspected of engaging in such activity.
You are solely responsible for reporting and paying any applicable taxes on your winnings, consistent with local, state, and federal regulations.
You agree not to:
Violate any law, regulation, or third-party right
Engage in fraudulent, deceptive, or unethical behavior
Use bots, scripts, or automated systems to interact with the Platform
Attempt to circumvent geographic or jurisdictional restrictions
Harass, abuse, or threaten any other user or employee
Impersonate another individual or provide false identity information
Violation of this section may result in immediate account suspension, loss of funds, and legal prosecution.
All content, features, and functionality on the Platform, including but not limited to logos, software code, graphics, audio, and user interfaces, are the exclusive property of Pick It Ticket and are protected by intellectual property laws.
We grant you a non-transferable, non-exclusive, revocable, limited license to use the Platform for personal, lawful, non-commercial purposes only.
By posting or submitting any content (e.g., usernames, messages, reviews), you grant us a perpetual, royalty-free, worldwide license to use, display, and distribute such content in connection with the operation and promotion of the Platform.
Your use of the Platform and participation in wagering activities are at your own risk. We do not guarantee winnings or positive outcomes from any wagers placed.
The Platform is provided on an “AS-IS” and “AS-AVAILABLE” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, under no circumstances shall Pick It Ticket, its affiliates, directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or emotional distress, arising out of or in connection with your use of the Platform.
Our total liability to you for all claims arising under these Terms shall not exceed the greater of: (i) the amount you deposited on the Platform in the previous six (6) months; or (ii) $500 USD.
You agree to defend, indemnify, and hold harmless Pick It Ticket and its officers, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
Your breach of these Terms
Your use of the Platform
Your violation of any law or regulation
Your infringement of any third-party rights
These Terms shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to its conflict of law principles.
All disputes arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The seat of arbitration shall be [Insert City/State]. The language of arbitration shall be English.
You agree to waive any right to participate in class actions or class-wide arbitration.
We reserve the right to amend these Terms at any time. Changes will be effective upon posting to the Platform with a revised “Last Updated” date. Your continued use of the Platform constitutes acceptance of any modified Terms.
We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, notice, or liability. Upon termination, all rights granted to you under these Terms will cease immediately.
Severability: If any provision of these Terms is deemed invalid, the remainder shall remain in full force and effect.
Entire Agreement: These Terms constitute the entire agreement between you and Pick It Ticket regarding the Platform.
Force Majeure: We shall not be held liable for any delay or failure to perform due to causes beyond our reasonable control.
No Waiver: Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.
